2. The Unique Phone offer (“The Offer”) is available to new and existing Orange Pay Monthly customers from 1 November 2006 until 31 October 2007 inclusive subject to the additional terms set out below excluding business customers (“The Eligible Customers”)

3. The Unique Phone service offers you the ability to:
a. Make and receive voice calls over the Orange Wireless Broadband Network when in range of the Livebox in your home
b. Make and receive voice calls over the Orange Mobile Network
c. Send and receive text messages
d. Send and receive multi media messages and email over the Orange Mobile Network

4. You need to have an activated Orange Wireless Broadband service in order to make and receive calls over the Orange Wireless Broadband Network.

5. If you are an Eligible Customer you must be on Canary £50 with Unique phone tariff or Panther £65 with Unique phone tariff (an “Eligible Tariff”) to qualify for the Offer.
 
6. Connection is subject to status and an 18-month minimum term contract. Connection to Broadband is subject to you having a BT landline and your exchange being able to support it.

7. The Offer is that you will receive an Orange Broadband package, normally £17.99 per month, inclusive as part of your Eligible tariff at no additional cost. This package provides download speed of up to 8 Meg, is subject to a 2GB usage allowance and includes a Livebox which is provided to you on loan and enables you to make and receive telephone calls by attaching a tone dial/ touchtone telephone to the Livebox. Speeds in excess of 2 Meg are only available in certain areas and the top speed may vary significantly depending on how far you live from your local exchange. If your line won’t support our fastest broadband speeds we’ll give you the best speed your line will support.
 
8. Orange Broadband is subject to standard terms and conditions and a broadband fair usage policy.

9. Any charges for additional Broadband services will be billed separately.
 
10. You will not receive the Broadband element of the package if you already have or someone in your household already has a free Orange Broadband connection. If you are an existing Orange Broadband customer you can change to the Broadband package included as part of your Eligible Tariff by contacting customer services.
 
11. There is no 14-day money back available in Orange Retail Stores with this Offer.

12. If you are on an Eligible Tariff the Offer will be applied to your account for the period you remain on an Eligible Tariff and have your Unique Phone device paired with an activated Livebox.

13. The Offer is available to Orange Pay Monthly customers on or connecting to an Eligible Tariff.

14. You will be charged according to the Eligible Tariff. Calls to standard UK landline numbers and Orange mobile customers will be free if the call was originated with the Orange Broadband icon visible on the Unique Phone device as set out in the User Guide instructions, which indicates that the call has been originated within the range of the Livebox. Any other standard minutes not made when the icon is visible will be included in your bundle. Any calls made outside of the bundle or non-standard calls will be charged at our published rates.

15. The Offer is subject at all times to a fair usage policy on the calls made while connected to the Livebox of six hours each day. Usage above this amount will constitute abuse and Orange may, at its discretion, monitor usage and withdraw the Offer from your account in the event that the fair usage policy is abused.

16. All international calls will be made using the Orange mobile network and charged in accordance with our standard published mobile rates. Please see our website for details.

17. You will receive a bill from Orange itemising the calls made via your Unique Phone device and a separate statement from Orange Broadband showing your monthly broadband charge at zero and any additional calls made using the Wireless and Talk service.

18. Orange Broadband must be registered to one person in the household. There can only be one Broadband account per billing address. The registered Broadband user can choose up to six other users to receive the Unique Phone Service via the activated Orange Wireless broadband connection. Once the registered Broadband account holder has chosen the other users the Unique Phone device of the other user(s) can be paired with the Livebox. Calls will then be routed via the Livebox when the device is in range to activate the Unique Phone Service. The customer will then benefit from the Offer.

19. You are strongly advised not to make 999 and 112 emergency calls using the Unique Phone service. Alternative arrangements should be made and a primary home telephone line maintained.

20. The Offer is not available in conjunction with any other Orange promotions, discounts or offers unless specified. It is not available with Handset Buyback or Member Get Member or Free Broadband promotions.

21. If your account is terminated for any reason you will no longer qualify for the Offer. Broadband will then be charged at the Standard User rate per month for Broadband. (see our website for details).

22. Orange mobile network services are subject to the Standard Terms and Conditions for the supply of Orange mobile Network Services, a copy of which can be found at the back of your Orange phone User Guide. These terms will apply for all calls made via the Unique Phone device.

23. If Orange Broadband cannot be provided to you because of technical or other reasons then you shall be notified by Orange Broadband by email as soon as possible; you may then be instructed to return any equipment to Orange.

24. No cash alternative is available in whole or in part.

25. Orange reserves the right to amend these terms and conditions at any time on reasonable notice.

26. Orange reserves the right to replace, amend or withdraw this Offer on reasonable notice.

27. Promoter is Orange. References to Orange in these terms and conditions are to Orange Personal Communications Services Limited, whose registered office is at St James Court, Great Park Road, Almondsbury Park, Bradley Stoke, Bristol CS32 4QJ.
